1. Acceptance of Terms
By downloading, accessing, or using the Hyvra mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
The Service is operated by Hyvra (ABN 95 997 493 901), based in New South Wales, Australia ("we", "us", "our").
2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. We reserve the right to terminate accounts of users found to be under the minimum age.
3. Health and Fitness Disclaimer
IMPORTANT — PLEASE READ CAREFULLY
Hyvra provides AI-generated training recommendations, coaching programs, and fitness guidance for informational and educational purposes only. The Service is not a substitute for professional medical advice, diagnosis, or treatment.
- Always consult a qualified healthcare professional before beginning any new exercise program, particularly if you have a pre-existing medical condition, injury, or health concern.
- The AI coaching recommendations provided by Hyvra are generated based on the data you provide and are not tailored to your individual medical circumstances.
- Training involves inherent risks, including physical injury. You assume full responsibility for any risks associated with your participation in activities suggested by the Service.
- If you experience pain, dizziness, shortness of breath, or any other unusual symptoms during exercise, stop immediately and seek medical attention.
By using the Service, you acknowledge that Hyvra is not liable for any injury, illness, or adverse outcome resulting from following training recommendations provided by the Service.
4. Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your password and account credentials
- Notify us immediately of any unauthorised use of your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.
5. Beta Service
The Service is currently in beta. During the beta period:
- The Service is provided free of charge
- Features may change, be added, or be removed without notice
- The Service may experience downtime, errors, or data loss
- We may terminate the beta at any time
- Feedback you provide during beta may be used to improve the Service
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Upload or transmit viruses or malicious code
- Use the Service in any manner that could damage, disable, or impair it
- Scrape, harvest, or collect data from the Service without our written permission
- Use the Service to develop a competing product or service
7. Connected Third-Party Services
The Service allows you to connect third-party fitness platforms and services including Apple Health (HealthKit), Garmin, Strava, Whoop, Polar, Wahoo, and others. By connecting these services:
- You authorise Hyvra to access and use data from those platforms in accordance with our Privacy Policy
- You agree to comply with the terms of service of those third-party platforms
- You acknowledge that Hyvra is not responsible for the availability, accuracy, or content of third-party platforms
Apple HealthKit
By connecting Apple Health, you authorise Hyvra to read health and fitness data from the HealthKit framework. You may revoke this access at any time through your iPhone's Health app settings. Hyvra's use of HealthKit data complies with Apple's HealthKit guidelines — HealthKit data will not be used for advertising or shared with third parties without your explicit consent.
8. AI-Generated Recommendations
The Service uses Anthropic's AI to generate training recommendations. By using the AI coaching features:
- You acknowledge that AI-generated recommendations are based on the data you provide and are not a substitute for professional advice
- You understand that AI recommendations may not always be accurate or appropriate for your individual circumstances
- Your training data is transmitted to Anthropic's API for processing in accordance with our Privacy Policy and Anthropic's terms
9. Intellectual Property
All content, features, and functionality of the Service — including but not limited to software, text, graphics, logos, and the Hyvra AI coaching system — are owned by or licensed to Hyvra and are protected by Australian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial use. This licence does not include any right to:
- Reproduce, distribute, or publicly display Service content
- Modify or create derivative works from Service content
- Use Service content for commercial purposes
10. User Content
You retain ownership of any content you submit to the Service (training logs, profile data, photos). By submitting content, you grant Hyvra a non-exclusive, royalty-free, worldwide licence to use, process, and store that content solely for the purpose of providing the Service.
11. Subscription and Payments
The Service is currently free during the beta period. When paid subscriptions are introduced:
- Pricing and features will be communicated in advance
- Payments will be processed through RevenueCat in conjunction with the Apple App Store, Google Play Store, or other authorised payment providers
- Subscriptions will automatically renew unless cancelled before the renewal date
- Refund policies will be governed by the applicable app store's policies
- You may cancel your subscription at any time through your App Store or Google Play account settings
12. Push Notifications
With your permission, the Service may send push notifications including training reminders, program updates, and coaching nudges. You may disable push notifications at any time through your device settings.
13. Marketing Communications
If you sign up for the Hyvra waitlist or opt in to marketing communications, you may receive email updates about the Service. You may unsubscribe at any time by clicking the unsubscribe link in any email or contacting us at hello@hyvra.io.
14. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by contacting support@hyvra.io.
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
15. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Any defects will be corrected
- The Service or servers are free of viruses or harmful components
- AI-generated training recommendations are accurate, complete, or suitable for your individual circumstances
16. Limitation of Liability
To the maximum extent permitted by applicable law, Hyvra and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim (or AUD $100 if you have not made any payments).
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud, or for any other liability that cannot be excluded under Australian Consumer Law.
17. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or condition imposed by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified.
18. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising from these Terms or your use of the Service.
19. Changes to Terms
We may update these Terms at any time. We will notify you of material changes by email or through the app. Continued use of the Service after changes constitutes acceptance of the updated Terms.
